BOOKING TERMS AND CONDITIONS
Four Elements Adventure reserves the right to amend, implement new, or retract items within the Terms and Conditions at any time.
Bookings are only made upon the receipt of payment, booking forms, and following our confirmation.
COVID-19 TERMS & CONDITIONS
These sets of terms & conditions replace the pre-existing terms and are applicable from the 1st of February 2020. They will remain in place until such time as the World Health Organisation declares the pandemic over and social distancing and travel restrictions are lifted.
Once these conditions are removed, all bookings will revert back to Four Elements Adventure's standard terms and conditions.
In order to adhere to this recognised Global Force Majeure event, and to obey to restrictions enforced by the UK Prime Minister on the 23rd March 2020 we have amended our standard terms to allow guests to postpone the activity booking up to an unlimited time from their original booking date and carry forward 100% of the booking’s value regardless of any price increases.
Four Elements Adventure reserve the right to change or adapt course delivery accordingly to suit conditions in order to keep everyone safe.
We appreciate that due to the level of uncertainty you may be considering cancelling your booking. Our advice to our customers is not to do so as this may result in loss of deposits and monies paid being unrecoverable. At this time, we strongly advise deferring your bookings to ensure all monies paid are retained for future use. We have reviewed our deferment policy and can now extend the validity of a voucher from 18 months to an unlimited period.
When booking a course, full payment is taken by Four Elements Adventure. A declaration form must be filled in and completed on arrival at the centre before a person can take part in any course. Four Elements Adventure do not accept any liability for loss caused by failure to complete the declaration form.
Four Elements Adventure require 100% of the total course cost when booking and have the right to cancel a person’s place on the course if full payment is not received. Course reminders will not be sent.
Any cancellations or changes to your booking must be made in writing and will only be accepted from the date they are received by Four Elements Adventures. Four Elements Adventure will offer a voucher if for any reason it is deemed unsafe to deliver an activity.
STANDARD TERMS & CONDITIONS
FEES & PAYMENTS
Courses are booked upon receipt of a completed booking form and deposit / full payment / purchase order request. Upon the clearance of payment your booking will be made, this will be confirmed via email.
· A 100% payment is required to book a course unless otherwise agreed.
· Cash on delivery or BACS (Bank) transfer is deemed as an acceptable means of payment.
If you want to pay on credit card you can do this via PayPal
CANCELLATION BY CLIENT
· All cancellations must be made via email or letter.
· COURSE FEES AND DEPOSITS ARE STRICTLY NON-REFUNDABLE
· If you are no longer able to make your course date then we try our best to move you to a later course date in that same season. However, this will depend on availability.
· We will always offer you an alternative course date where possible or a voucher to be used at any time that suits you.
· Please contact Four Elements Adventure to discuss postponement arrangements; as a default these have to be treated as
cancellations but we will endeavour to accommodate where possible.
CANCELLATION BY FOUR ELEMENTS ADVENTURE
Whilst every attempt is made to ensure that all our courses actually run, Four Elements Adventure will notify the client of cancellation at the earliest possible opportunity where we believe on reasonable grounds that cancellation is necessary due to but not limited to unsuitable conditions for the course or low course uptake.
Four Elements Adventure reserve the right to change or adapt course delivery accordingly to suit conditions.
Four Elements Adventure reserve the right to cancel courses within one week of the course date if bookings are below the minimum requirement.
In the event of cancellation clients will be offered the choice of the following options:
1. A full refund of the course fee paid.
2. Another course on different dates or a voucher.
Four Elements adventure reserve the right to remove a client from a course due to incapacity or inability to fulfil the demands or the course on grounds of safety. In such circumstances, the client will not be entitled to a refund. Four Elements Adventure will not be liable for any losses resulting from this decision.
LIABILITY & RISK
All courses delivered by Four Elements Adventure & our associates Newquay Activity Centre, take place in environments that are not without inherent risk.
We make every effort to minimise risks to our clients. All risks cannot be removed entirely; therefore any clients booking with us accept these risks as part of their chosen course.
Four Elements Adventure assume no liability in respect of personal injury, loss, damage or third party claims which occur through no fault of their own or their instructors and cannot accept responsibility for any of the reasons cited above that a person may incur whilst participating in any of the activities unless Four Elements Adventure can be proven negligent.
By accepting these terms & conditions you accept that you participate at your own risk and confirm that you have your own insurance to cover any such injury, loss, or damage or you have chosen not to take out such insurance even though you understand that this is your responsibility.
You must declare any medical conditions (e.g. asthma, epilepsy etc.) or any other special needs that may affect your or others’ safety whilst participating and accept Newquay Activity Centre / Four Elements Adventure do not accept any responsibility for any conditions not disclosed. You accept that you will not be permitted to consume alcohol or drugs prior to or during the activity sessions. Staff reserve the right to refuse participation to anyone considered to be under the influence of alcohol or drugs.
We recommend all clients obtain their own insurance to cover any accident or injury that may occur.
LOSS & DAMAGE
Any losses or damage to the equipment supplied by Four Elements Adventure or Newquay Activity Centre caused by the actions of an individual or group member will be invoiced to the person or organisation booking activities on that individual or group member's behalf.
It is recommended that individuals or groups using their own equipment ensure that this is adequately insured and appropriate prior to the commencement of the course. We will accept no responsibility for injury or death occurring from the use of the client's own equipment.
We cannot be held responsible for loss or damage to personal property whilst attending our courses. Personal insurance is again recommended to cover such circumstances.
The accommodation providers listed on the website act as a guide only to assist in booking accommodation.
No responsibility is taken by Four Elements Adventure for booking any accommodation and they cannot be held responsible for any aspect of or problems arising from accommodation arrangements.
Complaints concerning the centre or the activities should be referred to, Four Elements Adventure management at the end of the session and followed up in writing within 7 days of the session/course. Four Elements Adventure will act accordingly to do everything possible to rectify the situation and issue a written reply.
Any lost property will be kept at Four Elements Adventure / Newquay Activity Centre for a period of 2 days. If the item is not collected within that time frame, then Four Elements Adventure reserves the right to dispose of the item. This includes Identification that has been unclaimed after surf equipment has been hired. No exception will be made.
Four Elements Adventure reserves the right to move or change course dates due to any unforeseen circumstances. We will endeavour to help facilitate these changes with you and keep you informed of any issues that would cause a change in dates as soon as they are known to us.
If FCO (Foreign and Commonwealth Office) guidelines change on the run-up to your course and advise against travel to our destination is made, your course will be cancelled and you should contact your personal travel insurer to reimburse your course fees and flight costs.
